All bikes and bike kits are sold as-is and where-is. Except for the 30-day guarantee below, Triangle Motorized Bikes ("TMB") and its owner make no warranties of any kind, express or implied, including any implied warranty of merchantability or fitness for a particular purpose.
If you are not satisfied, contact us within 30 days of pickup or delivery for a refund of the bike's purchase price. The bike must be returned in the same condition it was received, less normal wear. Return shipping or transport is the buyer's responsibility. Refunds cover the bike price only, not shipping or fees.
Motorized bicycles, mopeds and electric bikes are regulated differently by state, county and city based on engine size, motor wattage and top speed. It is solely the buyer's responsibility to know and follow all applicable laws — including any registration, title, license, insurance, minimum age, helmet, lighting and equipment requirements — and to operate the bike only where it is legally permitted. The buyer accepts all risk of citations, fines, towing, impoundment, arrest or other penalties. TMB and its owner are not responsible if a rider is stopped, cited or penalized for riding on a street, sidewalk, trail, path or property where the vehicle is not allowed.
Riding any motorized or electric bicycle is inherently dangerous and can cause serious injury or death. The buyer, and anyone who rides or operates the bike, assumes all such risk. To the fullest extent allowed by law, the buyer releases, discharges, and agrees to hold harmless and indemnify Triangle Motorized Bikes, its owner Martin, and anyone acting on its behalf, from any and all claims, demands, damages, injuries, deaths, losses, costs and liabilities arising out of or relating to the purchase, assembly, service, maintenance, malfunction, failure, modification, resale or use of the bike — whether by the buyer or any other person, and whether caused by a product defect, ordinary negligence, or any other cause.
These are mechanically assembled and serviced bicycles and engine kits. Before and during every use the buyer is responsible for inspecting the bike, keeping all bolts and fasteners properly tight, and performing regular maintenance — including correct 2-stroke fuel mixing at 32:1 on gas models, and brake, tire, battery and chain upkeep. Running straight gas with no oil in a 2-stroke engine will damage it and voids the guarantee.
The engine displacement or motor wattage for each model is listed on its product page. How a bike is legally classified (bicycle, motorized bicycle, moped, motor vehicle, or e-bike class) depends on those figures and on local law, and can change if the bike is modified. The buyer is responsible for confirming how their specific bike is classified where they live before riding on public roads.
The buyer certifies they are at least 18 years old. These bikes are not toys and are not intended for use by children.
An order is confirmed only when payment is received. Pickup orders may be paid in person at pickup. Prices, discounts and availability can change without notice.
This agreement is governed by the laws of the State of North Carolina, without regard to its conflict-of-law rules. Any dispute will be brought only in the state or federal courts located in Wake County, North Carolina, and the buyer consents to that venue.
These terms are the entire agreement between the buyer and TMB regarding the sale and replace any prior discussions. If any part is found unenforceable, the rest still applies.
In plain terms: the bike is sold as-is with a 30-day money-back guarantee; you are responsible for registration, licensing, insurance and riding legally; and you agree that TMB and its owner are not liable for citations, injuries, accidents, or damage that result from using the bike.
