Plain English rules for promoting TMB. Please read before you sign up.
This Affiliate Agreement (the "Agreement") is between Triangle Motorized Bikes, owned by Martin Mkary, 2881 N Broad St, Holly Springs, NC 27540 ("TMB", "we"), and you, the person signing up ("Affiliate", "you"). By checking the box and submitting the signup form, you agree to this Agreement. Your checkbox and submission count as your electronic signature.
You must be at least 18 years old, live in the United States, and give us true information. One account per person. We may decline or remove any affiliate for any reason.
You are not an employee, partner, franchisee or agent of TMB. You cannot make promises, sign agreements, take payments or give warranties on behalf of TMB. You pay your own costs of promoting.
We pay commissions once a month by Cash App, Venmo or PayPal, after the sale has been paid in full, the bike has been picked up or delivered, and the 30 day money back window has passed. If a bike is returned, refunded, charged back or the order is cancelled, no commission is owed, and if one was already paid we may take it out of your next payout. We must be able to verify who you are before your first payout.
You are responsible for your own taxes on commissions. We may ask you for a completed IRS Form W-9 before paying you, and we may send you and the IRS a Form 1099 when the law requires it. No W-9 when asked means no payout until we get one.
The FTC requires it. Every post, video, story, comment or message that includes your code or link must clearly say it is paid, for example #ad, #paidpartner or "I earn a commission if you buy with my code." Put it where people see it without clicking "more" (on video, say it out loud too). Hiding it breaks this Agreement.
We give you a limited, free, revocable permission to use the TMB name, logo, bike photos and videos we send you, only to promote TMB under this Agreement. Do not change our logo, do not create accounts, pages or websites that look like they are run by TMB, and stop using our brand when this Agreement ends. You let us repost content you make about TMB, with credit to you.
You are responsible for your own content, your own riding and your own compliance with the law. You agree to defend, indemnify and hold harmless TMB and Martin Mkary from claims, fines, damages and costs (including reasonable attorney fees) caused by your content, your statements, your riding or your breaking this Agreement. If you ride a bike to make content, you do so at your own risk and you accept the risks of riding a motorized or electric bike, including injury. TMB is not liable to you for lost profits or indirect damages, and our total liability to you under this Agreement is limited to the commissions you earned in the 3 months before the claim.
Either of us can end this Agreement at any time, for any reason, by email or message. We can change commission rates or these terms by posting a new version on this page; changes apply to sales made after the new version is posted. Commissions you earned on valid sales before an end or change still get paid, unless you broke this Agreement. Breaking sections 7, 8 or 9 means you lose unpaid commissions on the sales connected to that breach.
North Carolina law governs this Agreement, and any dispute will be handled in the state or federal courts for Wake County, North Carolina. If one part of this Agreement cannot be enforced, the rest still applies. This page is the whole agreement about the affiliate program. Questions: info@ridetmb.com.
